The terms "nurtureuk", "we", "us", "our" and "ours" when used in this document mean nurtureuk. The terms "you", "your" and "yours" mean any user of the site.
Nurtureuk maintains this site and any courses offered on the site for the use of its customers, partners, and other site users (“Users”) upon agreement to the following terms, which may also be modified by specific written agreements or contracts we have with you or your organisation. Please read the Terms of Use carefully before using the site. Use of the site indicates acceptance of these Terms of Use (as modified by any separate agreements we have with you, with your employer, or with a third party commissioning services on your behalf) and forms a binding agreement between you and nurtureuk. If you do not agree to these Terms of Use, do not use this site.
Any breach of these Terms of Use automatically terminates your authorised use of the Site.
The Site and the course content within the Site are intended for Users within the United Kingdom, and we make no claim of their suitability for Users outside of this area. For users outside of the United Kingdom, we cannot guarantee that these Terms of Use, or our Data, Privacy and Cookies policy comply with all relevant laws.
About your data
It is important that you are aware of the following Terms of Use before starting using the Site. In particular, that you understand that:
Any data inputted, shared or processed by users on the Site will be processed in line with the requirements of the Data Protection Act 2018 and the UK General Data Protection Regulation (GDPR) and our Data, Privacy and Cookies policy and in accordance with other relevant UK laws.
Any data inputted, shared or processed by users on the Site may be used for research purposes, only after being anonymised and aggregated so that no pupil, user or organisation may be identified.
It is your responsibility to access the Site using a secure device that protects your data from unauthorised access.
It is your responsibility to ensure your password is safe and securely stored, and that you do not share your account credentials with any other user.
Changes and updates to the Terms of Use
These Terms of Use may be changed by us from time to time with or without notice to you. The latest Terms of Use will be posted on the Site, and you should always review these Terms of Use prior to using the Site to ensure that you have a current understanding of the Terms of Use under which you are permitted to access this Site. Use of the site
Nurtureuk provides various materials on this site and in courses offered through this site (the “Materials”). We authorise each User to view the Materials in accordance with the specific terms of use for each course or item, which should be made clear in the joining instructions for the course.
Suspension and termination of subscriptions and user accounts
We reserve the right to terminate your access to your user account if you commit any material breach of these Terms of Use. For clarity, we reserve the right to suspend your account at any time if we suspect that other users are using your account details, or if we suspect that the registration details of users within your organisation are being used by anyone else.
On termination of an account, any rights to use the Site and service will cease.
If your user account is inactive for two years, we reserve the right to lock your account and archive your data. We reserve the right to archive all data older than five years. See the Data, Privacy and Cookies policy for further details on how we handle, use, retain and delete your data.
If your use of the Site is terminated early because of breach of these Terms of Use, any payment you have made is not refundable, though we may, at our sole discretion, choose to refund part of any fee.
Warranty and exclusion of liability
We warrant that we shall exercise reasonable skill and care in providing the Site and the service.
While we endeavour to ensure the availability of the Site and the service at all times, we exclude liability for any lack of availability of the Site and the service. From time to time, we may restrict access to the Site for maintenance, or for any other reason.
We disclaim nurtureuk officers, directors, representatives, employees and volunteers disclaim any liability, loss, or risk incurred as a consequence, directly or indirectly, from the use and application of the Boxall Profile assessments and/or the Site or service.
To the fullest extent permitted by applicable laws we, on behalf of our employees and volunteers, exclude liability for any losses and expenses of whatever nature and howsoever arising including, without limitation, any direct, indirect, special, punitive, or consequential damages, loss of use, loss of data, loss caused by a virus, loss of income or profit, loss of or damage to property, claims of third parties, or other losses of any kind or character, even if we have been advised of the possibility of such damages or losses, arising out of or in connection with the use of this Site or any Site with which it is linked. You assume total responsibility for establishing such procedures for your data backup and virus checking as you consider necessary on all devices you use to access the Site or use the service.
We exclude all liability for any information and materials added or recommended by users.
Indemnity and release
You agree to indemnify, release and hold us harmless as well as our officers, directors, representatives, employees and volunteers from any claim, liability, loss, expense or demand, including legal fees, related to your violation of these Terms of Use or your access or use of this Site, the service, or any of the information, materials, products or services available through this Site.
Intellectual property
We retain all intellectual property rights to the Materials (including copy, content, images, design elements, trademarks and logos) save those rights specifically granted to you under these Terms of Use.
Users may view Materials on this site as part of a course purchased from or used with prior written agreement with nurtureuk, and may (if this facility is available for the Materials in question), download and print a maximum of one copy of the Materials provided that Users make no modifications to the Materials and retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials. Users may not modify the Materials at this Site in any way or reproduce, share, publish or distribute them, without the prior written agreement of an authorised representative of nurtureuk.
Entire understanding
These Terms of Use and the Data, Privacy and Cookies Policy contain the entire understanding between you and us, unless exceptional terms have been agreed with nurtureuk, with respect to this Site and service, and no representation, statement, inducement oral or written, not contained herein shall bind any party to this agreement. Should any part of these terms for any reason be declared invalid by a court of competent jurisdiction, such determination shall not affect the validity of any remaining portion and such remaining portion shall remain in full force and effect as if the invalid portion of these terms had been eliminated. Our failure to enforce any provision of these Terms of Use shall not be deemed a waiver of such provision nor of the right to enforce such provision.
